1. About Us

TheGrowthLabX (“TGLX”, “we”, “us”, “our”) is a Texas business that provides revenue‑optimization products and done‑for‑you marketing services, including:

Digital products (e.g., Fast Sales Vault Bundle, VA Success Kit);Consulting & audits (e.g., Revenue Leak Audit™, 360° Revenue Engine Audit™);Implementation & DFY programmes (Sales Accelerator Implementation™, Revenue Acceleration Engine™).

2. Acceptance of Terms

By accessing https://www.thegrowthlabx.com (“Site”) or purchasing any TGLX product/service (collectively, “Services”), you (“Client”, “User”) agree to be bound by these Terms & Conditions (“Terms”) and our Privacy Policy. If you do not agree, do not use the Site.

3. Eligibility & Account

You must be at least 18 years old and have authority to bind the entity you represent.

Accurate information is required during checkout or onboarding; you are responsible for keeping details current.


4. Products, Pricing & Payment

4.2 Payment Processing

Payments are processed via Stripe, PayPal, Apple Pay or Google Pay. All fees are due in full at checkout unless a written installment plan is agreed.

5. Delivery

Digital products: Immediate access via secure download link (and emailed within 10 minutes of purchase)

• Onboarding questionnaire sent instantly after checkout.

Revenue Leak Audit report delivered within 3–5 business days of form completion.

360° Audit report delivered within 7–10 business days of form completion

• Kickoff call scheduled once contractual onboarding is complete.

• Strategy build & asset configuration: 15–21 business days post‑onboarding.

• Fulfillment (lead delivery / booked‑call engine) begins no later than Day 21, unless otherwise agreed in writing.


6. Refunds & Performance Guarantees

6.1 Digital Products (Fast Sales Vault Bundle, VA Success Kit)

14‑Day “This Is Trash” Guarantee – If you are not satisfied for any reason, email sales@thegrowthlabx.com within 14 calendar days of purchase for a full refund. Proof of completed product review (e.g., screenshots or notes) may be requested to reduce fraud.

6.2 Revenue Leak Audit™ & 360° Audit

$5K Opportunity Guarantee:


If this audit doesn’t surface at least $5,000 in recoverable or new revenue opportunities within 60 days, I’ll refund every penny — no questions asked.


To qualify for the refund, you must:

• Submit all requested onboarding information

• Provide access to your lead, sales, and follow-up systems

• Attend your strategy call

• Show a reasonable attempt to implement the Action Plan provided in the audit

• Notify us within 7 days of receiving the report.

• Provide evidence of full cooperation (call attendance, data access).

We will — at our discretion —

(i) refine the audit once at no cost,

or (ii) refund the $497 fee.

6.3 (Sales Accelerator Implementation™/ DFY Services  Revenue Acceleration Engine™)

Sales Accelerator Implementation™ — 90-Day ROI Guarantee (Bundled Clients Only)


For clients who purchase the Sales Accelerator Implementation™ as part of a bundle, we offer a 90-Day ROI Guarantee

If you do not achieve a minimum 2× return on your investment within 90 days of implementation, you may choose between:


• A complimentary extension of service

or
• A refund of 30% of your paid fee

To be eligible for this guarantee, you must:

• Complete all onboarding steps
• Provide full access to systems needed for fulfillment

• Actively participate in implementation

• Demonstrate reasonable effort to apply the strategy

This policy exists to ensure fairness and accountability for both parties. Abuse of this guarantee or failure to cooperate in good faith voids eligibility.

DFY Services  Revenue Acceleration Engine™

Performance Guarantee: If Client completes onboarding, supplies all requested assets, and implements TGLX recommendations in good faith, TGLX guarantees delivery of the core KPI stated in the Master Services Agreement (e.g., 30 qualified booked calls for the Growth tier) within 60 calendar days of funnel launch.

If that KPI is not achieved:

  1. Remedy Option A – Continued Work: TGLX will continue service at no additional labor cost until the KPI is met.

  2. Remedy Option B – Partial Refund: Client may request a refund equal to 30 % of the service fee paid (max $750 for Growth tier, $1,250 for Scale tier, $2,000 for Pro tier).

Client must choose one remedy; both parties must sign a brief addendum documenting the election.

Exclusions:

*Ad‑spend, SaaS platform fees, and third‑party costs are non‑refundable.

*Guarantee void if Client delays approvals > 3 business days, alters TGLX assets without consent, or fails to follow up with leads as instructed.

**Except for the Performance Guarantee above, all DFY fees remain non‑refundable once strategy execution begins, unless otherwise required by law.---

7. Intellectual Property

All content, frameworks, scripts and deliverables remain TGLX intellectual property. You receive a non‑exclusive, non‑transferable license for internal business use only. Resale, public distribution, or reverse‑engineering is prohibited without written consent.

By default, TGLX may reference anonymized or non-confidential client results (e.g., performance metrics, win rates, before/after snapshots) for educational or marketing purposes. We will never disclose sensitive business details or identifying data without prior written consent.

If you prefer not to have your results referenced in any format, please notify us in writing at jojo@thegrowthlabx.com. All content, frameworks, scripts and deliverables remain TGLX intellectual property. You receive a non‑exclusive, non‑transferable license for internal business use only. Resale, public distribution, or reverse‑engineering is prohibited without written consent.


8. Client Obligations

Provide timely access to CRM, sales data, scripts, and personnel as requested.

Implement recommended actions or acknowledge that results depend on execution quality.Refrain from misrepresenting TGLX materials as your original IP.


9. Disclaimer of Warranties

TGLX delivers proven methodologies but does not guarantee specific revenue outcomes beyond stated refund guarantees. All Services are provided “AS IS”. You accept full responsibility for business decisions made using TGLX advice.

10. Limitation of Liability

To the maximum extent permitted by law, TGLX’s total liability for any claim shall not exceed the fees you paid in the 3‑month period preceding the claim. No consequential or punitive damages will be owed.

11. Indemnification

Client agrees to indemnify and hold harmless TGLX and its agents from third‑party claims arising out of Client’s misuse of deliverables or violations of these Terms.

12. Governing Law & Dispute Resolution

*Governing law: State of Texas, USA, without regard to conflicts rules

*Disputes: Good‑faith negotiation ➜ if unresolved, binding arbitration under AAA rules in Williamson County.

*Small claims ≤ $5,000 may be filed in your local court if permitted.


13. Changes to Terms

We may update these Terms and will post the revised date. Material changes will be emailed to active clients at least 14 days before taking effect.

14. Digital Millennium Copyright Act (DMCA)

TheGrowthLabX respects the intellectual property rights of others. If you believe that content available on our Site infringes upon any copyright you own or control, you may submit a written notification pursuant to the Digital Millennium Copyright Act ("DMCA") by providing our designated agent with the following information:

  1. A physical or electronic signature of a person authorized to act on behalf of the copyright owner;

  2. A description of the copyrighted work claimed to have been infringed;

  3. A description of the material that is claimed to be infringing and where it is located on the Site;

  4. Your contact information, including address, telephone number, and email address;

  5. A statement that you have a good faith belief that the use of the material is not authorized by the copyright owner, its agent, or the law;

  6. A statement that the information in the notification is accurate and, under penalty of perjury, that you are authorized to act on behalf of the copyright owner.

4. SMS Communications

By submitting your phone number, you consent to receive text messages from TheGrowthLabX related to service updates, appointment reminders, lead generation results, and promotional offers. Message frequency varies. Standard message and data rates may apply. You may opt out of SMS communications at any time by replying STOP

5. Cookies & Tracking

We use first‑party cookies (functional) and third‑party cookies (Google Analytics, Facebook Pixel, LinkedIn Insight Tag).

6. Data Sharing

Internal personnel within TheGrowthLabX and affiliated team members on a need-to-know basis.

Trusted third-party fulfillment partners or subcontractors under NDA and/or Data Processing Agreements (DPAs), when necessary to deliver services (e.g., white-label ad teams, appointment setters).

Legal authorities when required by law or subpoena.

All processors and partners sign Data Processing Agreements (DPAs) or equivalent confidentiality clauses. Data Processing Agreements (DPAs).

7. International Transfers

Data may be stored on US‑based servers. For EEA residents, transfers rely on Standard Contractual Clauses (SCCs) and supplementary measures.

8. Retention

•Contact & purchase data: 7 years (tax law).

•Marketing consents: until you withdraw.

•Audit client content: retained indefinitely unless otherwise requested in writing by the client. This allows us to support long-term strategy improvements, continuity across phases, and future upgrades.
